Overflow AI is an AI-powered phone answering service designed for tour operators and activity businesses. The Service includes:
- AI-powered call answering and routing
- Message taking and transcription
- Appointment booking capabilities
- Customer inquiry management
- Analytics and reporting dashboard
3. Account Registration
To use the Service, you must:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Be responsible for all activities under your account
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit harmful, offensive, or illegal content
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service's operation
- Use the Service for any fraudulent or deceptive purposes
5. Payment Terms
• Subscription fees are billed monthly in advance
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method on a recurring basis
• Price changes will be notified 30 days in advance
• Failed payments may result in service suspension
6. Intellectual Property
All content, features, and functionality of the Service are owned by Gondola Inc. and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you provide to the Service.
7. Privacy and Data Protection
Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.
8. Service Level Agreement
We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be communicated in advance when possible.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GONDOLA INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
10. Indemnification
You agree to indemnify and hold harmless Gondola Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Service will be immediately revoked. Provisions that by their nature should survive termination shall remain in effect.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
